Last Will & Testament

Estate Planning Lawyer in Denver

A Will is a legal document that specifies who is to receive your estate; who will administer the estate; and who will act as Guardian for your minor children if your spouse is deceased. The person who executes a Will is known as the Testator (male) or Testatrix (female). A Will can be handwritten or typed. Regardless, the Will must be signed and either notarized or witnessed by two individuals, preferably both.

The person designated in your Will to administer your estate is referred to as the Personal Representative; his or her job is to carry out the instructions laid out in the will. More specifically the Personal Representative is charged with the responsibility of: (1) paying creditor claims; (2) filing and paying federal income or estate taxes; and (3) distributing the assets of the deceased to the beneficiaries named in the Will.
